Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Adventure Buddy Beacon (the “Service”). The Service is operated by Adventure Buddy Beacon, LLC, a Colorado (USA) limited liability company (“ABB,” “we,” “us,” or “our”).
By creating an account, purchasing a subscription, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you reside in the European Economic Area (EEA), the United Kingdom (UK), or Switzerland, you may have mandatory consumer rights under your local law. Nothing in these Terms limits or waives those rights.

1. What ABB is — and is not
Adventure Buddy Beacon is a planning and notification tool that helps users define an adventure and notify selected contacts if that adventure becomes overdue, based on rules the user configures.
Adventure Buddy Beacon (ABB) is not an emergency service.
ABB does not contact emergency services, does not provide rescue coordination,
search and rescue, medical advice, or real-time monitoring, and does not replace calling
emergency services.
If you are in danger, contact local emergency services immediately
(e.g., 112 in most of Europe, 911 in the United States,
999 in the UK, or the applicable number in your country).
You must not rely on ABB as your sole or primary safety system.
2. Eligibility and account responsibility
You must be at least 18 years old to use the Service.
You are responsible for:
- maintaining the confidentiality of your login credentials;
- all activity under your account; and
- keeping your account information accurate and current.
3. User responsibility and assumption of risk
Outdoor activities involve inherent risks, including serious injury or death.
By using ABB, you acknowledge and agree that:
- you are solely responsible for your activities, decisions, preparedness, equipment, and routes;
- ABB does not assess conditions, terrain, weather, or feasibility;
- ABB does not verify your plans or timing; and
- technology failures, network outages, device issues, or third-party service failures may prevent notifications from functioning as intended.
You use the Service at your own risk.
4. Emergency contacts and consent
You may store and use contact information (email addresses and/or phone numbers) to send notifications.
You represent and warrant that:
- you have obtained any consent required by applicable law for contacts to receive SMS messages, and you will only send SMS to contacts who have accepted the invitation and completed phone verification;
- you will keep contact details accurate and up to date; and
- you will not use the Service for harassment, spam, impersonation, or unlawful communications.
ABB is not responsible for:
- incorrect or outdated contact information;
- a contact’s failure to respond; or
- actions or inactions taken by contacts.
5. Notifications and delivery limitations
Notifications rely on third-party services (including email and SMS providers), mobile carriers, device settings, and network conditions.
ABB does not guarantee:
- delivery,
- timing,
- order,
- frequency, or
- successful receipt of notifications.
Messages may be delayed, filtered, blocked, throttled, or fail entirely.
Availability and performance may vary by country, carrier, and device settings.
5A. SMS Messaging Terms
Adventure Buddy Beacon may send SMS (text message) notifications in connection with:
- account verification (including phone number verification),
- emergency contact alerts when an adventure becomes overdue, and
- follow-up safety notifications.
User Consent
By providing a mobile phone number and enabling SMS notifications, you consent to receive text messages from Adventure Buddy Beacon related to the Service. Message frequency varies based on your configured adventures and account activity.
Consent to receive SMS messages is not a condition of purchasing a subscription.
Message Frequency
Messages are sent only when triggered by user-configured events (such as account verification or an overdue adventure alert). Message frequency varies and may be zero in most months.
Message & Data Rates
Message and data rates may apply according to your mobile carrier plan.
Opt-Out
You may opt out of SMS messages at any time by replying STOP. After opting out, you will receive one final confirmation message.
ABB SMS messages include opt-out instructions. Some messages may also include: “Reply HELP for help, STOP to opt out. Msg&Data Rates May Apply.”

6. Free and Beacon Pro tiers
ABB may offer multiple plans, including Free and Pro tiers.
- Free tier: limited features or usage limits.
- Pro tier: additional features such as higher limits, premium templates, SMS notifications, or advanced configuration.
Current features and limits are described within the Plans page and may change as described in Section 16.
7. Paid subscriptions, Stripe billing, and auto-renewal
Payments
Paid subscriptions are processed by Stripe, our third-party payment processor. ABB does not store your full payment card details.
By purchasing a subscription, you authorize ABB (via Stripe) to charge your selected payment method for applicable fees and taxes.
Auto-renewal
Subscriptions automatically renew for the same billing period (monthly or annual) unless you cancel before renewal. The renewal price will be the price disclosed at renewal.
Cancellation
You may cancel auto-renewal through your account settings. Cancellation stops future billing but does not typically refund unused time in the current billing period, except where required by law.
Failed payments
If payment fails, we may retry and may suspend or downgrade access if payment remains unresolved.
8. EU / EEA / UK consumer rights
If you are a consumer in the EEA, UK, or Switzerland, additional mandatory protections apply.
Right of withdrawal
You may have a 14-day right of withdrawal for digital services purchased online unless:
- you request immediate access to the Service, and
- you acknowledge that you may lose the right of withdrawal once performance begins.
Where applicable, ABB will present this choice during checkout.
Service conformity
Nothing in these Terms limits your statutory rights relating to digital services, including rights relating to conformity, remedies, or termination under applicable consumer law.
9. Acceptable use
You agree not to:
- use the Service for unlawful, deceptive, abusive, or harmful purposes;
- send unauthorized or misleading communications;
- interfere with or disrupt the Service; or
- attempt unauthorized access or bypass technical safeguards.
We may suspend or terminate access for violations or to protect security or legal compliance.
10. Intellectual property
The Service, including software, design, branding, and content, is owned by or licensed to ABB and protected by intellectual property laws.
ABB grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
11. User content
You retain ownership of content you submit to ABB (such as adventure notes, template text, or profile information).
By submitting content, you grant ABB a limited, non-exclusive license to store, process, and display that content solely as necessary to operate, maintain, and improve the Service.
ABB does not claim ownership of your content and does not use it for advertising or resale.
12. Third-party services
The Service may rely on third-party providers (including Stripe, email services, and SMS carriers). ABB is not responsible for third-party outages, errors, or policies.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
ABB DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT NOTIFICATIONS WILL BE DELIVERED OR RECEIVED.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- ABB is not liable for indirect, incidental, special, consequential, or punitive damages;
- ABB is not liable for injuries, death, or property damage arising from outdoor activities or reliance on notifications.
ABB’s total liability for any claim will not exceed the greater of:
- the amount you paid to ABB in the 12 months before the claim arose, or
- USD $100 if no fees were paid.
This section does not limit liability that cannot be limited under applicable law.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold ABB harmless from claims arising from:
- your misuse of the Service;
- your violation of these Terms;
- your failure to obtain required consent from contacts; or
- unlawful or unauthorized communications sent through the Service.
16. Changes to the Service or Terms
We may update the Service or these Terms from time to time. Material changes will be communicated through the Service or by email.
Continued use after changes become effective constitutes acceptance of the updated Terms.
17. Governing law and jurisdiction
Users outside the EEA / UK / Switzerland
These Terms are governed by the laws of the State of Colorado, USA, excluding conflict-of-law principles. Courts located in Colorado will have jurisdiction.
EEA / UK / Switzerland consumers
You may bring claims in the courts of your country of habitual residence and benefit from mandatory local consumer protections.
